On July 7, 2020, Milimani Law Court magistrate Zainab Abdul released two rugby players, Frank Wanyama and Alex Olaba, on a cash bail of Ksh300,000 after they pleaded not guilty to charges of gang rape and committing an indecent act.
The High Court had ordered a retrial of the two players, who were initially convicted and sentenced to 15 years in prison. However, the conviction was quashed last week due to a lack of evidence that one of the key witnesses was sworn in before testifying.
According to the charge sheet, the two players are alleged to have committed the offence on February 11, 2018, at Seefa Apartment in Highrise estate in Nairobi County.
Magistrate Zainab Abdul noted that the court is not bound by the previous proceedings and that the two players face serious charges. She directed that the case be mentioned on July 21 for the purpose of fixing a hearing date.
The two players have been warned not to interfere with witnesses in the case, lest it cancels their cash bail.
