On July 7, 2020, a significant development took place in the ongoing saga surrounding Kakamega Senator Cleophas Malala's expulsion from the Amani National Congress (ANC). The Registrar of Political Parties, Ann N. Nderitu, announced that she would not be endorsing the party's decision to expel the senator.

The decision was met with a mix of reactions, with some seeing it as a major victory for Senator Malala. However, the Registrar's decision was not taken lightly, as it was based on two key reasons. Firstly, the disciplinary proceedings against Senator Malala were not conducted within the stipulated timelines as outlined in Article 49 of the ANC Party Constitution.

Secondly, the Registrar pointed out that the ANC's National Governing Council did not approve the Disciplinary Committee as reconstituted by the National Executive Council in line with Article 46 of the party constitution. This procedural irregularity was deemed sufficient to warrant the Registrar's decision not to endorse the expulsion.
