On July 7, 2020, the Registrar of Political Parties, Anne Nderitu, dealt a significant blow to Amani National Congress (ANC) party leader Musalia Mudavadi by rejecting the party's attempt to expel Kakamega senator Cleophas Malala.
The Registrar's decision was based on the party's failure to follow the scheduled process outlined in the ANC Party Constitution. Specifically, the disciplinary proceedings were not concluded within the stipulated timelines under Article 49 of the ANC Party Constitution.
Additionally, the National Governing Council did not approve the disciplinary committee as reconstituted by the NEC in line with Article 46 (1) (d)(ii) of the ANC party Constitution.
According to the Registrar's letter, the party's move to expel Malala did not adhere to the required procedures, rendering the expulsion invalid.
Malala was accused of disobeying the party and its leader through a special meeting of the National Governing Council last month. However, the party's attempt to expel him has been thwarted by the Registrar's decision.
