Registrar Rejects ANC's Bid to Expel Kakamega Senator

On July 7, 2020, a major setback was dealt to the Amani National Party (ANC) as its attempt to eject Kakamega senator Cleophas Malala was rejected by the Registrar of Political Parties Anne Nderitu.

The Registrar's decision was based on the grounds that the manner in which Malala was expelled from the party was not in line with the law.

According to Nderitu, her office was unable to endorse and execute the party's request due to glaring gaps in procedures and processes preceding the resolution.

"Subsequent to the review of the submission on the expulsion of the said party member against the applicable laws including the ANC Party Constitution, the Office is unable to execute your request," she explained.

The Registrar also noted that the disciplinary process was not conducted within the stipulated time as required by Article 49 of the ANC Constitution.

Furthermore, Nderitu pointed out that even though the party disciplinary committee had resolved to oust the senator, the decision was not approved by the National Governing Council.
