Malala's ANC Expulsion Bid Fails

On July 7, 2020, Kakamega Senator Cleophas Malala can breathe a sigh of relief after the office of the Registrar of Political Parties declined to execute a request by Amani National Congress (ANC) to expel him from the party.

The Registrar, Ms. Ann Nderitu, cited procedural gaps as the reason for turning down the request. According to her, the disciplinary proceedings were not concluded within the stipulated timelines under Article 49 of the ANC Party Constitution.

Additionally, the Registrar noted that the National Governing Council did not approve the Disciplinary Committee as reconstituted by the NEC in line with Article 46 (1)(d)(ii) of the ANC Party constitution.

ANC's Governing Council had approved the expulsion of Senator Malala on June 26, 2020, after the disciplinary committee in November last year suspended and summoned him to appear and respond to charges made against him during an Orange Democratic Movement party rally.

However, Senator Malala failed to respond to the charges and refused to appear before the committee to defend himself, leading to the decision to expel him.
