On 26th June 2020, the ANC National Governing Council voted to expel Kakamega Senator Cleophas Malala, citing gross misconduct and disloyalty to the party.

However, the Registrar of Political Parties, Anne Nderitu, has nullified the move, ruling that the ANC party failed to follow the due process outlined in their constitution.

According to Nderitu, the disciplinary proceedings against Malala were not concluded within the stipulated timelines, and the National Governing Council did not approve the Disciplinary Committee as reconstituted by the NEC.

Malala risked losing his senatorial seat if the ANC party had succeeded in expelling him, but thanks to Nderitu's ruling, he remains in office.
