On July 7, 2020, the Registrar of Political Parties, Ann N. Nderitu, made a crucial decision regarding the fate of Kakamega Senator Cleophas Malala within the Amani National Congress (ANC) party.
The Registrar refused to endorse the ANC's decision to expel Senator Malala, citing two key reasons for her decision.
Firstly, Ms. Nderitu pointed out that the disciplinary proceedings against Senator Malala were not conducted within the stipulated timelines as outlined in Article 49 of the ANC Party Constitution.
Secondly, the Registrar noted that the ANC's National Governing Council failed to approve the Disciplinary Committee as reconstituted by the National Executive Council in line with Article 46 of the party constitution.
