Tuskys Supermarket Faces Contempt Proceedings Over Unpaid Leave Directive

Published on July 4, 2020, a letter from the Kenya Union of Commercial Food and Allied Workers (KUCFAW) to Tuskys Supermarket warned against effecting an unpaid leave directive.

The directive, communicated to staff in late June, was met with resistance from the union, which had previously sought court orders to stop Tuskys from sacking 80 employees without following proper procedure.

‘Take notice that should you authorise the ill-advised action to be implemented, we shall have no other recourse but to institute contempt proceedings against you and any of your agents or assigns who are bent on disobeying the courts and its orders’, the letter stated.

The union cited a court order issued on June 3, 2020, which prohibited pay cuts or salary reductions, and argued that there was no mutual agreement to send employees on mandatory unpaid leave.

KUCFAW further warned Tuskys that they had invited the company to dialogue on the matter, but their calls had been ignored.

It remains to be seen if Tuskys will proceed with the unpaid leave directive.
