DPP Haji Urges Speedy Hearing of DJ Evolve Case

On June 29, 2020, a heartbreaking story about DJ Evolve aired on NTV, prompting Director of Public Prosecutions Noordin Haji to take action.

Haji urged the Judiciary to prioritize the hearing of the case, which had been delayed due to Covid-19 disruptions.

Embakasi East MP Babu Owino is facing charges of second-degree murder after allegedly shooting DJ Evolve in January 2020.

The victim, Felix Orinda alias DJ Evolve, lies at home unable to do anything by himself due to the severe injuries he suffered.

According to the law, second-degree attempted murder means that the accused acted without premeditation, or acted in a fit of passion.

First degree attempted murder, on the other hand, means the person intentionally, and with premeditation, tried to kill someone else.

Commentators argue that it would be hard for the prosecution to prove that the incident was premeditated and intentional, given that the two had apparently been close friends.

Second-degree murder also includes deaths that occur while the accused is engaged in committing another felony, such as arson or burglary.

Second-degree attempted murder attracts a lengthy prison sentence, often ranging from between 5 to 15 years in prison.

The incident has left DJ Evolve paralyzed and unable to move many of his ligaments, effectively robbing him of control over his fingers which as a DJ were his tools of trade.

Babu Owino has committed to paying the hospital bill, which has hit Ksh17 million, but the DJ's family struggles to make ends meet due to his mother's inability to work.
