Unlawful Sacking Leads to Sh. 1.6 Million Payout ¶
The Kenyatta family's Brookside firm has been ordered to pay Sh. 1.5 million to 80-year-old plumber David Gicheru for using his picture in a calendar without consent.
Additionally, the family will pay Sh. 139,200, including 11 months' compensation, for Gicheru's unfair sacking from Gicheha Farms in 2018.
According to a High Court ruling delivered in January this year and sustained by Justice Hellen Wasilwa, Gicheru was fired after complaining about the unauthorized use of his photo.
The court rejected the family's claim that they were not given a chance to be heard, stating that they were aware of the ongoing court proceedings and had received court papers from Gicheru in October 2019.
Justice Wasilwa ruled that the family's counsel had ignored their duty to the respondents and failed to attend court and file necessary documents, leading to the denial of their application to set aside the judgment.
