LSK's Covid-19 Mask Directive Challenge Fails in Court

On June 27, 2020, the High Court dealt a significant blow to the Law Society of Kenya (LSK) by dismissing their case against the Ministry of Health's directive to curb the spread of Covid-19.

The LSK had sought to stop the mandatory face mask directive, which carried a Ksh 20,000 fine for individuals found disobeying the rule.

However, Justice James Makau ruled in favor of the government, stating that the directive was necessary for public safety and that granting the LSK's wish would be equivalent to handing Kenyans a 'death sentence'.

"The measures and steps undertaken under the Public Health (prevention, control, and suppression of Covid-19) should be supported for the good of all," Justice Makau stated.

The judge further warned that revoking the government's directive would fuel the spread of Coronavirus, putting the lives of many Kenyans at risk.
