Mudavadi's ANC Party Expels Senator Malala Amid Questions Over Legality

On June 26, 2020, Musalia Mudavadi's ANC party expelled Kakamega Senator Cleophas Malala from its membership, a move that has raised questions about its legality.

The party's officials, including Mr. Mudavadi, had their term expire, and a petition was filed at the Office of the Registrar of Political Parties regarding the legitimacy of the party's leadership.

Senator Malala risks losing his seat if the Registrar of Political Parties, Ms. Anne Nderitu, upholds the decision to expel him.

The decision to expel the senator was made at a specially convened National Governing Council (NGC) meeting at the party's Amani House secretariat, attended by about 50 delegates.

According to ANC resolutions, the NGC adopted and ratified the decision of the internal disciplinary committee to expel Mr. Malala from the party's membership.

The party claims that Mr. Malala was given a fair chance to defend himself but chose to snub the invitations and insult the party officials.

However, Senator Malala seemed to downplay the claims of his expulsion during a Senate session, stating, 'Let me make it clear that I am still the Senator of Kakamega.'

Nominated MP Godfrey Osotsi, who is fighting his own expulsion from the party in court, dismissed Senator Malala's expulsion as illegal, calling it a 'political joke of the year.'
