On June 26, 2020, the Amani National Congress (ANC) party, led by Musalia Mudavadi, expelled Kakamega Senator Cleophas Malala for alleged disloyalty.

Malala, who was serving his first term in the Senate, had been accused of being disloyal to the party after he campaigned for an ODM candidate in the Kibra by-election in December 2019, despite ANC having its own candidate in the area.

According to ANC, Malala's actions were a betrayal of the party's trust and a clear indication that he had joined forces with the ODM party, led by Raila Odinga, after the by-election.

Malala had been leading a Senate committee of 11 members in investigating the impeachment of Kirinyaga Governor Anne Waiguru. The committee submitted its report to the Senate on June 26, 2020, and cleared Waiguru of any wrongdoing.

Malala's expulsion from ANC comes after he had been at odds with the party leadership, particularly over his stance on the Building Bridges Initiative (BBI) bill.
