On June 24, 2020, the Employment and Labour Relations Court took a significant step in upholding the rule of law by suspending a recruitment notice for the position of Director-General for the Communications Authority of Kenya (CA).
The court's decision was made in response to a suit lodged by the Information Communication Technology of Kenya (ICTAK), which accused CA of disregarding the law in the recruitment process.
According to ICTAK, the recruitment notice was discriminatory and heavily tainted with illegality and impropriety. The regulator was also accused of failing to detail several specifications, including proposed remuneration, which could pose a risk to fair competition and merit.
Justice Maureen Odero of the Employment and Labour Relations Court agreed with ICTAK's concerns, stating that CA should strictly adhere to the law in filling any legally prescribed position.
As a result, the court allowed ICTAK to file proceedings to have the recruitment notice quashed. This decision is a significant setback for CA's plans to appoint a new Director-General, who would replace Wangusi, who left the position last year after serving two terms.
