Kidero Accuses Judge of Bias in Raid on His Premises

On June 24, 2020, former Nairobi governor Evans Kidero accused a judge of bias in a raid on his premises.

According to Kidero, Justice Mumbi Ngugi demonstrated bias by saying he was guilty of being in possession of corruptly acquired public assets.

He further alleged that the judge was decidedly biased against him, suggesting he was a criminal or already guilty of criminal activities.

Justice Ngugi had dismissed a petition by Kidero, his wife Susan Mboya, and his companies, challenging a search warrant obtained by the EACC in September 2018.

The judge allowed the anti-graft agency to search his houses and offices, prompting Kidero's appeal.

‘The judge erred in fact and in law and misdirected herself by referring to the 1st Appellant’s (Mr Kidero) “criminal activities” without any factual basis for such reference, thereby giving away the judge’s unfair preconceived bias and predetermined notion,’ Kidero said in the appeal.
