Published on June 22, 2020, Nairobi Governor Mike Sonko has asked President Uhuru Kenyatta to rein in national government officers involved in the implementation of the agreement between the two parties, citing continued commission of illegalities.
According to Sonko, the President should initiate a process to address the anomalies raised by the court in its ruling last week, which vindicated the governor's claims of illegalities committed by national government officers.
The court, in its ruling, found that the National Government had not followed the rule of law in the implementation of the Deed of Transfer of functions between the two governments, and suspended the declaration of illegality for a period of 90 days.
During this period, the National Government is expected to establish the Nairobi Metropolitan Service (NMS) by law and provide the instrument of its establishment. The court also directed that the issue of the secondment of 6,052 Nairobi County government staff to NMS be addressed within the period.
However, Sonko does not want the nullification of the agreement, but rather wants everyone involved in the implementation process to start doing what is right within the law, so that by the time the petitioners go back to court, everything will be in order.
“The governor remains committed to the implementation of the Deed as it is his brainchild. He hopes that the President can initiate a process of discussion within the shortest time possible so that obligations are made clear in terms of national and county governments,” said Ben Mulwa, Sonko's spokesperson.
