On March 30, 13-year-old Yasin Moyo was tragically killed in Kiamaiko, Nairobi. The case against the accused policeman, Dancun Ndiema, was set to begin on that day.
However, Ndiema's lawyers claimed he had developed Covid-19 symptoms and was undergoing a test at Mbagathi Hospital. As a result, the plea taking was postponed to await his medical results.
Justice Daniel Ogembo directed the Independent Policing Oversight Authority to investigate Ndiema's status and for the defence to provide the court with all the test records of the accused.
State counsel Wangui Gichuhi sought a warrant of arrest or summons for Ndiema, suggesting that if he had Covid-19, the state could facilitate his stay.
