Cop Accused of Killing Yassin Moyo Fails to Take Plea Amid COVID-19 Fears

On June 19, 2020, the High Court deferred the plea taking of a police officer accused of killing a 13-year-old boy, Yassin Moyo in Huruma early March this year.

The court was informed that the police officer, Duncan Ndiema, had exhibited COVID-19 like related symptoms and was at Mbagathi hospital waiting for necessary tests and results.

Lawyer Danstan Omar proposed that the court take a raincheck, citing the sensitivity of the disease.

The prosecution asked the court to issue a warrant of arrest or issue summons for the accused to appear in court to take plea, adding that if he tests positive for the new coronavirus, the state would facilitate.

Magistrate Daniel Ogembo directed that the IPOA investigates the condition of the accused and that depending on the outcome of the medical report, the police officer would take plea physically or virtually.

The defense was also directed to table all the tests records of the accused before the court.

Yassin Moyo was shot on March 27, 2020, while watching police patrol the streets with his mother and siblings. A stray bullet struck him in the stomach during a coronavirus-related curfew.

His father, Hussein Moyo Molte, recounted hearing gunshots moments before his daughter called to tell him that Yassin had been shot.
