DPP Seeks to File Additional Charges Against Ex-CS Rashid Echesa

On June 17, 2020, Director of Public Prosecution Noordin Haji announced plans to initiate further charges against former CS Rashid Echesa, who is facing fraud-related charges over a Ksh.40 billion fake military tender.

Echesa was charged with criminal offences related to fraud, and the DPP now seeks to have orders directing that Echesa's car and firearms be surrendered to him reviewed.

According to the DPP, the State is holding the vehicles pursuant to Section 26(C) of the criminal procedure code, where it is mandated to detain and search items purported to have been unlawfully acquired.

However, Echesa has objected to the application, arguing that the State has no powers to invade his privacy and his right to own property.

He claims that he has tabled evidence to show that he bought the said Range Rover and that no one has claimed the vehicle.

Echesa further argues that the charges he is facing have no nexus with the said motor vehicle and that it is not mentioned in any of the offences he is facing.
