Judge Withdraws from Tuju Case for Second Time

On June 17, 2020, Commercial Court Judge Grace Nzioka withdrew from a case in which East Africa Development Bank (EADB) is seeking to recover Sh1.6 billion from Dari Limited, a firm owned by Jubilee Secretary General Raphael Tuju.

The judge cited concerns over the integrity of the court, stating that it would be in the interest of substantive justice for the matter to be heard before another court.

This is the second time Judge Nzioka has withdrawn from the case, with the first instance occurring on June 2, 2020.

Earlier, Tuju's lawyers, Paul Muite and Paul Nyamodi, had accused Judge Nzioka of tilting the scales of justice in favour of EADB, claiming that she had failed to address an application to commit EADB's directors and its receivers to civil jail for allegedly harassing, interfering with, and disrupting Dari's business.

However, EADB lawyer Fred Ojiambo denied the allegations, stating that Tuju's lawyers were employing a delaying tactic to prevent the bank's receivers from taking over Dari.

Justice Nzioka ordered that the file be placed before Justice Mary Kasango, who had previously handled the case and had ordered Dari directors to allow EADB's receivers to take over the firm.
