Court Blocks Treasury CS Yattani's Plan to Disband Strategic Food Reserve Trust Fund

On June 11, 2020, High Court judge Weldon Korir dealt a major blow to Treasury Cabinet Secretary Ukur Yattani's bid to save on national expenditure by winding up some State corporations and channelling funds to support the government's development projects.

The Strategic Food Reserve Trust Fund, established in 2015, provides a platform for storing reserve food on behalf of the government. However, in April 2020, Mr Yattani issued a legal notice to disband the fund by revoking the Public Finance Management Act of 2015.

Activist Okiya Omtatah filed a petition against the decision, citing concerns that the Sh10 billion in the fund's accounts could be misappropriated. 'The legal notice by the CS has no transition mechanisms to secure the Fund's assets and resources, including the Sh10 billion which is held in its bank accounts,' said Omtatah.

Justice Korir ruled that the orders suspending the decision will be in place until July 1, 2020, when the suit will be heard.
