Court Blocks Treasury CS Yattani's Plan to Disband Strategic Food Reserve Trust Fund

Nairobi, June 11, 2020 - In a major blow to Treasury Cabinet Secretary Ukur Yattani, the High Court has blocked his plan to disband the Strategic Food Reserve Trust Fund.

The court's decision, issued by Judge Weldon Korir, suspends Yattani's decision to revoke the Public Finance Management Act of 2015, which established the fund.

The Strategic Food Reserve Trust Fund was established in 2015 to provide a platform for storing reserve food on behalf of the government.

Activist Okiya Omtatah had filed a petition against Yattani's decision, citing concerns that the Sh10 billion allocated to the fund could be misappropriated.

“The legal notice by the CS has no transition mechanisms to secure the Fund’s assets and resources, including the Sh10 billion which is held in its bank accounts,” Omtatah said.

Justice Korir's orders will remain in place until July 1, when the suit will be heard.
