Published on June 10, 2020, Nairobi County Assembly Member of County Assembly (MCA) Abdi Guyo has obtained interim court orders to prevent investigations into his alleged breach of assembly privileges.
According to Standing Order 242 of the County Assembly, a member is required to obtain written permission from the Speaker before being absent from sittings. However, Mr. Guyo is accused of missing more than eight consecutive sittings without permission.
As a result, the Powers and Privileges committee of the assembly was set to investigate his conduct, which constitutes a breach of privilege. However, Mr. Guyo has obtained interim orders from the Milimani High court to stop the committee from holding any sittings to investigate his conduct.
The court has also issued an interim order staying the implementation of the report of the Powers and Privileges committee relating to its investigations against Mr. Guyo pending inter-partes hearing of the application.
Mr. Guyo's actions have sparked controversy, with many questioning his absence from crucial sittings. The Nairobi County Assembly has been listed as the second respondent in the application, along with the Speaker of the Assembly, the Clerk of the Assembly, and the Powers and Privileges Committee.
