HIGH COURT has awarded tech entrepreneur Ndiang’ui Kinyagia Sh5 million over violations of his rights during the 2025 raid on his Kinoo home, and barred the police and DPP from prosecuting him using the unconstitutional investigative process.
Kinyagia had been linked to the viral June 25 protest timetable, which started with prayers, praise and worship, a moment of silence for those killed during the 2024 anti Finance Bill protests and speeches by bereaved parents, before listing running battles with police and gatherings at major Nairobi roundabouts.
The timetable then proposed a march to State House at 1pm, lowering the UDA presidential standard, raising the Kenyan flag, declaring a new republic and swearing in a transition council, with investigators later treating the post as a serious security matter.
The court ruling now means the State cannot simply rely on an investigative process found to have violated his constitutional rights when seeking to prosecute him over that episode.
