A complex property dispute in Garissa has taken a dramatic and troubling turn as disputed claimant Sheikh Hussein Ali emerged victorious in a court ruling under circumstances that have left the affected parties questioning the integrity of the judicial process, with reports indicating that he presented a National Identity Card in his legal submissions that was later determined by the National Registration Bureau (NRB) to belong to Salahdin Adan Sheikh, thus invalidating the documentation used to support his claims.
Correspondence from the National Registration Bureau, dated 7th February 2022 and addressed to the Sub-County Criminal Investigation Officer in Wajir East, confirms that the identity card number cited in the Garissa court case had been issued to Salahdin Adan Sheikh. The NRB attached authenticated extracts from the national register to the communication, explicitly stating that the ID number was not linked to Sheikh Hussein Ali, and provided a formal trail of verification that should have informed judicial deliberations.
Internal sources describe the sequence of events as a severe breach of legal protocol, noting that the court ruling directly contradicts official government records, creating a scenario where property rights are jeopardized and public confidence in institutional processes is undermined, particularly in northeastern Kenya where authenticated documentation and official verification serve as the primary means of safeguarding ownership and civil entitlements.
The affected party has indicated that the court appeared to disregard the NRB verification reports, which were submitted following a prior inquiry by the Directorate of Criminal Investigations (DCI) referencing Ref No DCI/C/GEN/6/10/VOL.II/251 dated 15th December 2021, and that the oversight has left them at risk of losing property to a claimant who, according to official records, holds no lawful entitlement to the disputed property.
