Kenya faces a new storm after Nelson Amenya, the man who exposed the controversial Adani deal, returned with another explosive allegation. This time, he claims President William Ruto’s administration is secretly negotiating a 25-year agreement with former U.S. President Donald Trump’s team that would hand over Kenya’s entire national health data system to Washington.
Amenya says the plan would allow the U.S. government real-time access to all Kenyan health records, disease samples, and national medical databases. He calls it a threat to Kenya’s sovereignty, a betrayal of public trust, and a direct attack on the country’s laws.
His revelations have already raised alarm among privacy experts, civil society groups, and health professionals who fear the agreement would strip Kenyans of their constitutional rights and place national health security in foreign hands.
Inside the Alleged Ruto-Trump Scandal
Nelson Amenya revealed details of the alleged deal during a briefing on Tuesday, December 2. He said the agreement would create a health security partnership between Nairobi and Washington, lasting 25 years and controlled under U.S. federal law.
According to him, the arrangement would give the U.S. government unrestricted, real-time entry into Kenya’s health databases. This includes HIV status, TB treatment history, children’s vaccination files and sensitive personal medical records.
Amenya calls the plan a “full surrender of Kenya’s medical privacy to a foreign power.”
He warns that disease specimens collected from Kenyan patients would be shipped to nearly ten American pharmaceutical companies. These corporations would use the samples for vaccine development and commercial research without any guaranteed benefit or compensation to Kenya.
He argues that the most dangerous clause is the one stating that the deal would be governed entirely by U.S. federal law. This, he says, automatically strips away the protection offered by Kenya’s Data Protection Act, Health Act and Digital Health Act.
“The Office of the Data Protection Commissioner becomes powerless. Kenyan law cannot protect you under this deal,” he says.
Amenya also claims that the U.S. side would gain a 24-hour system link to Kenya’s medical databases and the authority to audit 5 percent of Kenyan health facilities at any moment, without notice or obligation to consult the Ministry of Health.
He warns that should the Kenyan government reject the agreement, Washington could punish Nairobi with severe funding cuts, including health financing and security cooperation support.
Amenya calls this “economic blackmail hidden behind a health partnership.”
Kenya’s Health Data Would Be Wide Open
Amenya insists the Ruto-Trump Scandal deal exposes more than privacy. It exposes national security.
He says that health data is more than medical information. It reveals population trends, disease burdens, genetic patterns, and family histories.
Giving another government unlimited access creates risks that extend far beyond normal health research.
He argues that foreign control of national medical databases could influence policy decisions, medical supply chains, and emergency response planning. He believes it gives too much power to the U.S., while leaving Kenya with no firm protections.
Public health experts warn that once such a deal begins, reversing it becomes nearly impossible. For 25 years, Kenya could lose control of how its medical data is stored, shared, used, and monetized. “It is the medical privacy of more than 50 million Kenyans at stake,” Amenya says.
Kenyan Laws Would Be Ignored Under U.S. Federal Control
At the center of Amenya’s warning is the clause that states the agreement would fall under U.S. federal law. That means any data breach, misuse, or misconduct would be judged by American standards, not Kenyan law.
Kenya’s Data Protection Commissioner would have no power. Kenyan citizens would have no legal pathway to defend their rights. Even Parliament would be powerless once the deal takes effect. Legal analysts say this shifts the balance of power completely. Kenya would become a passive participant in its own health governance, while Washington makes key decisions.
Activists fear that once disease samples and health data enter U.S. systems, Kenya loses all claim to ownership. They warn that the deal resembles previous global health arrangements that favored pharmaceutical companies, not developing nations.
Amenya claims the agreement is unconstitutional and violates multiple Kenyan laws. He argues that no government has the right to surrender the privacy of an entire nation for two decades.
Threat of Funding Cuts Pressures Kenya
Amenya says the alleged agreement also includes a heavy threat. If Nairobi refuses to sign, he claims Washington could cut major health funding streams. This includes HIV programs, vaccine support, and emergency response financing.
He calls this a coercive tactic meant to force Kenya into compliance. Health workers fear that such pressure could push the government to sign the deal quietly, without public debate, in the name of protecting donor funding.
They warn that desperate governments often accept harmful deals when faced with the fear of losing foreign aid. Amenya says transparency is the only defence Kenyans have. “This deal cannot survive sunlight,” he says.
