On November 21, 2019, lawyer Jairus Otieno sent a demand letter to KMPDU Secretary-General Ouma Oluga and 11 other individuals, accusing them of violating the rights of David Kahuria Mundia, a member of the 'Real KMPDU' Facebook group.
According to the letter, Mundia was a lawful participant in the group, which had approximately 6,297 members, when Oluga and the others allegedly restricted and censored his activities without reason.
‘My client is one of the approximately 6,297 members of the group,’ the letter reads. ‘On or about 15 November 2019, when my client was lawfully participating in the activities of the Group, you decided, unilateral and without assigning any reason whatsoever, to restrict and censor my clients’ activities in the Group, including restricting his access to the Group, censoring and restricting his posts.'
Otieno demanded that Oluga and the others admit liability, issue a public apology, and restore Mundia's membership status within three days. Failure to comply would result in legal proceedings.
