McDonald Mariga has won again in the Kibra by-election after a court dismissed a case filed by Morris Peter Kinyanjui, who had sought to bar Mariga from contesting the seat on a Jubilee Party ticket.

On September 17, 2019, Kinyanjui had filed a case at the High Court seeking to bar Mariga from contesting the Kibra by-election, citing that Jubilee Party had not followed due process in selecting Mariga as its candidate.

However, the court ruled that the Jubilee Party's nomination of Mariga had been accepted by the Independent Electoral and Boundaries Commission (IEBC), and therefore, Kinyanjui's case had no merit.

The court also advised Kinyanjui to seek further assistance if he felt that the process had been unfair.

Mariga was nominated by Jubilee Party on September 14, 2019, and the by-election is set to take place on November 7, 2019.
