On September 17, 2019, a fresh dispute emerged in the Kibra parliamentary by-election as a Jubilee aspirant, Morris Peter Kinyanjui, moved to the Political Disputes Tribunal to challenge the nomination of former Harambee Stars midfielder McDonald Mariga.
According to Kinyanjui, the nomination process was not conducted in adherence to the party's constitution and laid-down regulations. He claims that he was assured by the Jubilee's National Elections Board (NEB) that the interview he underwent was not a nomination, but rather a selection process.
However, Kinyanjui alleges that he came to know of Mariga's nomination through media reports, and not through any official communication from the party. He further claims that the NEB's decision to select Mariga as the candidate was 'ultra vires', meaning it exceeded the board's powers.
It is worth noting that Kinyanjui had previously taken his complaints to the Jubilee's National Elections Appeals Tribunal, which dismissed his petition. He is now seeking the Political parties' disputes tribunal to hear his second complaint on Mariga's clearance to vie for the oncoming polls on a priority basis.
