Footballer McDonald Mariga's bid to contest in the Kibra parliamentary by-election is set to be decided on Monday, September 16, 2019, by the Independent Electoral and Boundaries Commission (IEBC).
The nomination of Mariga, the Jubilee Party's candidate for the November 7 mini poll, was invalidated by the electoral agency on Tuesday due to missing details from the voters' roll of 2017.
IEBC Chairman Wafula Chebukati announced on Friday that a ruling by the dispute resolution committee hearing the case filed by Mariga will be delivered on September 16.
Mariga's legal team, led by Elisha Ongoya, has called on the committee to remedy the error and allow the football star to participate in the mini poll.
According to Ongoya, the respondent, Kibra constituency returning officer Beatrice Saki Muli, erred in nullifying Mariga's candidature, which would deny voters in Kibra a right to choose their candidate of choice and disenfranchise the rights of the complainant.
However, the second interested party has sought to have the appeal dismissed, maintaining that Mariga registered outside the window required by the law and should not be part of the aspirants.
