On September 13, 2019, a contentious court ruling sparked debate over the access of governors charged in court to their offices. The Senate Public Accounts Committee, led by Homa Bay Senator Moses Kajwang', is now seeking clarification on whether the ruling applies to all state officers.
During a grilling session with Samburu Governor Samuel Lenolkulal, the committee chair questioned the implications of the ruling, citing concerns that it could be applied to other state officers, including MPs and members of county assemblies facing trial.
"What happens if a senator tomorrow faces a similar case? Would they be barred from Parliament? Would they be barred from attending committee meetings?" posed Mr Kajwang'. The committee plans to discuss the matter further during their plenary sessions in Kitui next week.
Lawyers and human rights activists have called for elected leaders facing criminal charges to be barred from office, citing Chapter Six of the Constitution on leadership and integrity.
