Surveyors Fault New Land Compensation Rules, Call for Review

On September 12, 2019, surveyors expressed concerns over the new land compensation rules, calling for an urgent review of the changes introduced by the land value amendment Act 2019.

The Institution of Surveyors of Kenya (ISK) criticized the one-year processing time for compensation payments, stating that it would cause inconvenience to affected parties.

ISK President Abraham Samoei emphasized the need for immediate compensation to allow affected individuals to settle in other areas.

The changes in the land value Act aimed to streamline land rates, rent, stamp duty, and compensation processes to ease the acquisition and access to private land for public infrastructure projects.

However, surveyors dismissed the changes, arguing that the drafters of the Act failed to consider value dynamics.

The land value amendment Act 2019, signed into law by President Uhuru Kenyatta on August 2, 2019, introduced provisions to prevent speculation by limiting compensation to parcel owners who have occupied their land for more than two years prior to acquisition.
