'There is no body!' lawyer defends Wairimu, wife of missing Dutch Tob Cohen

On September 12, 2019, Sarah Wairimu, the estranged wife of missing Dutch tycoon Tob Cohen, appeared in court with her lawyer Philip Murgor, who argued that there is no body to charge her with murder.

The 69-year-old Cohen went missing on July 19, 2019, and his wife was embroiled in a bitter divorce case over property worth hundreds of millions of shillings.

Prosecutors want Wairimu to undergo a mental assessment before she takes a plea, citing a charge of murder. However, Murgor opposed this, stating that 'there is no deceased as we speak.'

He argued that there is no evidence linking Wairimu to the alleged offence and requested that evidence be produced in court.

Prosecutors insisted that they can charge Wairimu without a body, as it is their job to prove that Cohen was killed.

George Kinoti led a team of investigators to Wairimu's home, where they were supposed to dig a compost pit but did not.

Justice Kariuki from Garissa ruled that the application would be deferred until next week, with Wairimu to be remanded at Langata Women's prison and undergo a mental exam.
