On September 9, 2019, a Kisumu court handed down a 10-year prison sentence to Teddy Nyabola, a mason, for defiling a Standard Eight pupil.
The court found Nyabola guilty of defiling the pupil on diverse dates between November 20 and 24, 2018, in Nyalenda slums.
According to the court, the girl had admitted to tricking Nyabola into sleeping with her by spiking his soft drink with alcohol.
Senior Resident Magistrate Winfrida Onkunya stated that the law is clear: a minor under the age of 18 is not capable of consent.
She noted that there was no evidence to prove that Nyabola made an attempt to avoid the act, and therefore found him guilty and convicted him.
