On September 10th, 2019, a shocking case of alleged child abuse came to light in Nyamira County. Magwagwa Ward Representative Fred Nyachae Omayio, a Member of County Assembly (MCA), was arraigned in court facing charges of defiling a 17-year-old girl.
According to the indictment, the alleged incident occurred on the night of September 2nd to 3rd at a guest house in Kisii town. The MCA is accused of committing an indecent act with a minor, contrary to Section 11(1) of the Sexual Offences Act No.3 of 2006.
During the court proceedings, MCA Nyachae pleaded not guilty to the charges and was detained for seven days pending a bail ruling. His attorney, Omoke Morara, requested the court to grant bail, citing the MCA's need to resume his duties and receive treatment for blood pressure.
However, the prosecution opposed the release, fearing that the MCA would interfere with witnesses in the case. A ruling on his application for bail is set to be delivered on Monday, September 16th.
