Embakasi North MP James Gakuya has been summoned to court to face charges related to land fraud, according to a 2021 report.
Gakuya was directed to appear before a Milimani magistrate on Thursday without fail where he will plead to charges of conspiracy to defraud contrary to section 317 of the Penal Code. It is alleged that he conspired to defraud Silvya Merie of a land in Runda measuring 0.2020 hectares.
The MP failed to turn up in court on Wednesday, citing a temporary order from High Court Judge Anthony Mrima halting proceedings. He argued the case involves a pending ownership dispute before the Environment and Land Court, claiming he is the registered owner with a valid search certificate.
Gakuya alleged the prosecution’s actions constitute an abuse of the criminal justice system, suggesting political motives. He linked the charges to his affiliation with the United Democratic Alliance (UDA) and support for Deputy President William Ruto, stating, "This is another attempt to intimidate me into abandoning my claim."
The MP also faces separate graft allegations related to constituency development funds. The case highlights tensions between legal proceedings and political affiliations in Kenya’s judicial landscape.
