On September 4, 2019, a case was filed in the International Court of Justice (ICJ) against its President's conduct in the Kenya-Somalia maritime dispute.
David Matsanga, Chairperson of the Pan African Forum, filed the suit, seeking the recusal of presiding judge Abdulqawi Ahmed Yusuf.
Matsanga's application cited subjudice and conflict of interest, alleging that Judge Yusuf had commented on the case outside court and was a Somali national.
"We have interest in the Kenya/Somali case as regional natives of the East and the Horn of Africa," Matsanga said.
He expressed concerns about a 'risk of an unbalanced and a biased outcome' in the case and urged Kenya not to participate in the ICJ proceedings if Judge Yusuf was on the panel.
"We call upon the government of Kenya not to take part in the proceedings on September 9, 2019 if the President of ICJ will be on the panel because this will create a miscarriage of justice," Matsanga said.
