On August 30, 2019, the High Court in Nairobi ordered the Judicial Service Commission (JSC) to pay lawyer Nelson Havi his fees, which he was owed as of November 1, 2019, after he was wrongly accused of misconduct.
According to the court, the JSC had wrongfully accused Havi of misconduct and had suspended him from work.
Justice Onganya stated that the complainant who had filed the case against Havi after he was suspended had lied about the circumstances surrounding the case.
"The complainant lied about the circumstances surrounding the case, the judge said.
Following the court's decision, the Judicial Service Commission (JSC) has been ordered to reinstate Brian Khaemba to his position as a magistrate in Kiambu, Kenya.
Khaemba was suspended in June 2019 after he granted bail to Kiambu Governor Ferdinand Waititu, who was facing corruption charges.
Waititu was later barred from accessing his office until the corruption case against him was resolved.
The corruption case against Waititu involved the loss of approximately KES 588 million in taxes.
