On August 31, 2019, the High Court dealt a significant blow to Sportpesa, dismissing their plea to enforce the Betting Control and Licensing Board (BCLB) to uphold its operational license.
Judge John Mativo ruled against Sportpesa, citing that the petitioner's license had expired and that there was no way the petitioner could operate on an expired license.
The court also found that Sportpesa failed to provide sufficient evidence to support their case and failed to demonstrate that the government violated their constitutional rights, thereby denying them compensation for damages.
Additionally, the court refused to compel the government to lift the suspension on Sportpesa's pay bill numbers, as the company had failed to meet the requirements.
Sportpesa had blamed the Betting Control and Licensing Board (BCLB) for suspending their pay bill and shortcodes, which had affected their daily operations.
