On August 30, 2019, a Nairobi court ordered the reinstatement of suspended Kiambu Principal Magistrate Bryan Khaemba, who had been suspended by Chief Justice David Maraga on June 13, 2019, for gross misconduct.
The magistrate, while on sick leave, had given anticipatory bail to embattled Governor Ferdinand Waititu, who is facing Sh588 million graft charges.
Mr. Khaemba's reinstatement was ordered by Justice Byram Ongaya, who ruled that the magistrate had been victimized for discharging his official duties.
Justice Ongaya said no judicial officer should be victimized for decisions or pronouncements made in the course of their duties.
Mr. Khaemba will resume duty on September 9, 2019, and will receive all his benefits, including full salary, by November 1, 2019.
The Kenya Magistrates and Judges Association welcomed Mr. Khaemba's reinstatement, saying it was a milestone for the judiciary in upholding the rights of its officers.
