On August 30, 2019, Governor Ferdinand Waititu, through his lawyer Tom Ojienda, moved to the Court of Appeal to challenge a decision by the High Court to bar him from accessing his county office.
Waititu argues that the High Court erred in its ruling, which stated that elected leaders facing graft-related charges should not continue to hold office.
He claims that the charges he is facing are not among the reasons cited for removal of a governor from office, and that the orders requiring him not to step foot in the county's offices amount to removal from office.
Waititu is also challenging the amount of money he had to part with to secure his freedom, claiming that a Sh15 million cash bail or Sh30 million bond is too much for an offence involving Sh51 million.
He wants the appellate court to reduce the cash bail to Sh2 million or grant bond of Sh5 million.
