On August 28, 2019, the Employment and Labour Relations court reinstated Francis Wangusi as the Director-General of the Communications Authority of Kenya.

The court's decision came after the Consumer Federation of Kenya (Cofek) filed a petition arguing that Wangusi's term had expired on August 21, 2019, paving the way for the appointment of a new Director-General.

However, the court ruled that the absence of a board makes the appointment of the acting director-general unlawful, effectively stopping the recruitment of a new director-general until there is a board in place.

CA had appointed Ms. Mercy Wanjau as the acting director-general to replace Mr. Wangusi, but the court's decision has reinstated Wangusi to his position.

The court scheduled a hearing for September 9th to further discuss the matter.
