Court Ruling Keeps Francis Wangusi in CA Director General Seat

On August 27, 2019, a court in Kenya extended orders preventing the appointment of a new Communications Authority Director General, effectively keeping Francis Wangusi in the seat.

Wangusi's term had expired the previous week, prompting the appointment of Mercy Wanjau. However, Wangusi refused to hand over, claiming the appointment was illegal.

The Consumers Federation of Kenya (COFEK) then filed a case in court to stop Wanjau's appointment, arguing that there was no valid board in place to make the appointment.

COFEK's lawyer argued that the 13-member board, led by Gituku, lacked the authority to recruit a new Director General for a state entity.

CA's lawyer, Githu Muigai, countered that the board was in place, albeit not fully constituted, due to a court order preventing the gazetting of some board members.

The case will be mentioned on September 10.
