DPP Accused of Delaying Rogue Lawyers Case

Published on August 27, 2019, a case of obtaining money by false pretence, forgery, and uttering a false document has been dragging on at the Office of the Director of Public Prosecutions (ODPP). The case involves two lawyers, M/s Odingo & Co. Advocates and M/s Kerario Marwa & Co. Advocates, who allegedly made millions from fake claims in courts and pocketed the loot from poor farmers.

According to documents obtained by Kenya Insights, the police files were first handed to the ODPP Migori by the DCI on February 27, 2019, for advice and directions. However, the case has been dragging on, with the ODPP Migori forwarding the files to the DPP Kisumu on June 19, 2019, without full legal analysis.

The DPP Kisumu returned the files to the ODPP Migori on July 16, 2019, to make a comprehensive legal analysis. Sony Sugar is now frustrated that the files have taken longer at the ODPP Migori/Kisumu than it took the investigations.

With DPP Haji cracking the whip and promising better service delivery, it's a concern that a case that was submitted in March has been dragging on. The accused lawyers need to have their case in court. Question to Mr. Haji, how long will this case drag and what action are you going to take over such incompetence on your officers?
