Aukot's appointment as a legal advisor to Ruto's camp highlights his longstanding role in constitutional reform. An allied MP noted his contributions during the 2010 constitution drafting process, emphasizing his legal expertise.
The High Court dismissed a 2020 challenge by Aukot against the BBI task force's constitutionality, undermining his previous campaign to overhaul the electoral system. This legal setback followed his 2017 endorsement of Uhuru Kenyatta's re-election, which contrasted sharply with his later criticisms of the president's policies.
During a 2020 interview, Aukot condemned the BBI as "a confusion, directionless, duplicitous of functions and a waste of money." He argued the initiative failed to represent Kenya's 46 million citizens, stating, "If I had that Sh10 billion given to them I would build proper classrooms." Aukot also questioned the BBI's lack of public consultation, noting, "How come out of the nine points none of them says go collect views to seek to amend the Constitution?"
The shift in Aukot's political alignment reflects broader tensions within Kenyan opposition circles ahead of the 2022 elections. His association with Ruto's faction suggests a realignment of key figures in the country's political landscape.
