On August 22, 2019, Moi University held its 38th graduation ceremony at the main campus in Eldoret, but the event was marred by controversy when at least 700 students' names were missing from the list.

Thirteen students, who were affected by this omission, took their case to the High Court in Mombasa, where they were awarded Ksh.50,000 each as nominal damages for infringement of their rights.

According to a court ruling delivered on Wednesday, the action of omitting the students' names was deemed 'discriminatory' and violated their rights to dignity, freedom from psychological torture, and fair administrative action.

As part of the ruling, the university was ordered to provide each of the affected students with the reasons for their non-inclusion in the final graduation list within 30 days.

The institution was also directed to undertake all necessary internal procedures to include the students in the next graduation list and ceremony within the next 90 days.

Additionally, Moi University was required to file a written report to the court on the progress made in compliance with the orders issued within the same period and bear the costs of the petition.
