On August 21, 2019, a case was filed against Chief Justice David Maraga, seeking his removal from office.
The petitioner, Fredrick Obilo, alleged that the Chief Justice failed to act on a case filed in 2016, despite having knowledge of it.
According to court papers, the Chief Justice failed to invoke Article 159 of the Kenyan Constitution to ensure a speedy and just hearing of the case.
Obilo claimed that the continued lease of the premises without a speedy resolution of the case or termination of the contract amounts to wastage of public funds.
He further alleged that the failure by the court to put an end to the wastage of public funds through the leased premises violates Section 79 (2) of the Public Management Act 2012.
Obilo accused the Chief Justice of abusing his office, contrary to the oath of office he took to uphold the dignity and respect for the judiciary.
