On November 8th, 2017, the Court of Appeal issued a directive restraining Makupa Transit Shade Limited from reclaiming a nine-acre land in the Indian Ocean.
The land, located at the Makupa Creek alongside the ocean, was intended for commercial use. However, the court order restricts the firm from using the land for any purpose, including private initiatives or dealings with third parties.
The directive was issued by appellate judges Wanjiru Karanja, Martha Koome, and Alnashir Visram, pending a ruling on an appeal by the environment land court in Mombasa.
The firm estimates the cost of its projects at over Kshs 500 million.
According to the ruling, the judges are optimistic that the appeal will succeed in restoring the reclaimed land to its original state.
