On August 18, 2019, the Employment and Labour Relations Court issued a directive to the Kenya National Bureau of Statistics (KNBS) to bar public servants from participating in the August 24 National Census as supervisors and enumerators.

The court's decision came after a petition was filed by residents of Home Bay County, who challenged the hiring criteria and occupation status of some individuals picked to help in the census.

According to the court, KNBS had already concluded the recruitment exercise and commenced training of officials, but the names of public servants hired as supervisors or enumerators were to be removed from the list.

Justice Maureen Onyango ordered KNBS, Homa Bay County Commissioner, county statistics officer, and the Attorney-General to hand in the list of supervisors and enumerators hired in Rachuonyo North Sub-County within 21 days.

The case will be heard in Kisumu on September 17, 2019.
