On August 15, 2019, a Nairobi court issued orders stopping the cremation of deceased Kibra MP Ken Okoth until a case filed by Ann Muthoni is heard.

Ann Muthoni, who claims to be Okoth's second wife, sued Okoth's mother, Angeline Okoth, and wife, Monica Okoth, along with Lee funeral home.

According to the petition, Muthoni was excluded from funeral and burial arrangements, and only learned of the plans through the media.

The family allegedly wanted to cremate the body 'among other reasons to primarily destroy any evidence of her son's lineage to Okoth.'

Senior Principal Magistrate GA Mmasi issued the order, which will be heard on August 9, 2019.

Former Nairobi Governor Mike Sonko had previously acknowledged the relationship between Okoth and Muthoni, stating that Okoth had confided in him about their relationship.
